(LIC) to settle an administrative and marketing breach related to its approval of a generic version of Nexium (esomeprazole magnesium) and its generic version of Prevacid (lansoprazole magnesium).
LIC has a marketing authorization and marketing control (MABC) from AstraZeneca covering all of the generic products with the active ingredients contained in the generics. Under the agreement, ICOS will provide Lilly with the full and upfront payment for the generic and its generic-based product, with full upfront payment for the full generic, in addition to the upfront payment for the generic version.
In addition to the upfront payment, Lilly will also provide full upfront payment for a settlement of its marketing breach related to the generic version of Prevacid, in order to resolve the generic version’s marketing issues.
LIC will continue to use the settlement agreement as a means of obtaining additional marketing authorization for its generic version of Prevacid. Lilly will continue to market and market the generic versions of both Prevacid and its branded counterparts, as well as all other generics to its customers for a minimum of two years.
